Terms of Service

1. Acceptance of Terms

By accessing or using Flightdeck ("the Service"), operated by Flightdeck Inc. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Flightdeck is a data integration and operations platform that connects business systems, transforms data into a unified model, and provides tools for teams to operate on that data. The Service includes web applications, APIs, CLI tools, and integrations with third-party services.

3. Accounts and Access

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

We may suspend or terminate access if we reasonably believe your use violates these terms or poses a security risk.

4. Your Data

You retain all rights to the data you connect to or process through Flightdeck ("Your Data"). We do not claim ownership of Your Data. We access Your Data only as necessary to provide the Service and as described in our Privacy Policy.

You are responsible for ensuring you have the right to connect and process data through the Service, including obtaining any required consents from data subjects.

5. Third-Party Integrations

The Service connects to third-party systems (CRMs, ERPs, payment processors, etc.) using credentials you provide. We use these credentials solely to sync and process data as you direct. You are responsible for complying with the terms of service of each third-party system you connect.

We are not responsible for the availability, accuracy, or security of third-party services. If a third-party service changes its API or revokes access, we will work to restore connectivity but cannot guarantee uninterrupted service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to store or transmit malicious code
• Exceed rate limits or use the Service in a manner that degrades performance for other users

7. Intellectual Property

The Service, including its software, design, documentation, and branding, is owned by Flightdeck Inc. and protected by intellectual property laws. These terms grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

8. Payment and Billing

If your use of the Service requires payment, you agree to pay all fees as described in your order or subscription agreement. Fees are non-refundable except as required by law or as explicitly stated in your agreement.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Flightdeck Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Flightdeck Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these terms.

13. Termination

Either party may terminate this agreement at any time. Upon termination, your right to access the Service ceases. We will make Your Data available for export for 30 days following termination, after which we may delete it.

14. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
